Every single signature gathered was taken fraudulently. The approval was done AFTER the signatures were gathered.

If only Maine GOP Exec Director had bothered to contact the Maine Secretary of State's office before he made this ridiculous claim that Roger so gleefully posted. From the ME SOS:

Here is our statement in response to the GOP press release on Question 2:

Submission of the registration application does not affect certification of a citizens’ initiative for the ballot. Citizens’ initiatives can only be invalidated for the reasons outlined in the Maine Constitution,Article IV, Part III, Sections 18-20. Additionally, the opportunity to legally appeal the decision to certify the petition expired 10 days after the certification was completed. http://legislature.maine.gov/statutes/21-A/title21-Asec905.html

Only business entities that receive compensation for “organizing, supervising or managing the circulation of petitions” qualify as petition organizations under the law and are therefore required to file a registration application. At the time of filing the citizens’ initiative request for An Act to Enhance Access to Affordable Health Care, the proponents did not file the registration form.

The petitions were issued Oct. 28, 2016 and signatures were submitted to the Elections Division on Jan. 25 and 26, 2017. The certification process was completed Feb. 21, 2017 with a finding that the effort had gathered enough valid signatures to move forward as proposed legislation.

It was brought to our attention late this summer that the registration document had not been filed and we followed up at that point to request the document. It was filed with our office on Aug. 29, 2017.

We have now changed our process to require the filing of the registration form prior to issuing the petitions, if the petitions are to be circulated by a qualifying “petition organization.”

I'm not going to study the language in the above, but surely Counselor Fair Share Weinand, who has a finely honed intellect when it comes to the letter of the law, is the final authority here.

Still, it sounds to me like the weasels have been hard at work crafting pronouncements.

The trick here is that finding in favor of the existing law would have self-incriminated the AG's office for not enforcing the law to begin with.

Do you really think an AG who wants to be Governor would do that? Especially when she is about to get 70,000 new voters with our money?

Question 1 is a bill of

Question 1 is a bill of attainder specifically prohibited by both the Maine and federal Constitution. Question two is an unconstitutional on two grounds, the first being the same as Question 1 and the second not within the Charter under the Constitution being the defense of the people of Maine. Question 3 is unconstitutional in that requires a borrowing which the state is not allowed to make except for those items for which taxes are expected to recoup in the fiscal year. That is tax anticipation bonds. The fourth question is one of compensation for labor and not a legal but a contractual one. Pensions are deferred income and another loophole in tax law that discourages savings and outside the purview of the government's police power or defense of people's lives, freedoms and property.

These are just a few examples of how politicians have emasculated the limited powers of government as defined in our state and federal constitutions and all of these examples and more are covered in my latest book, The Constitution, a Document Steeped in History and a Compromise Devoid of Promise.
