Lance Tapley is a joke. He often cites himself as authority inhis articles. I have often read articles where he accuses the prison officials as evil for restraining an inmate,and then noting later in the article that the inmate was suicidal -- apparently a coincidence, DESPITE the "prison oficials" having the "excuse" that the guy was suicidal. I'm not talking cases where these guys are HURTduring restraint. He is against the restraint.
I sometimes imagine a release of all these fellows into Lance's care. What would happen in Lance's house of rehabilitation? With luck, we'd find enough of his sodomized, beaten, robbed remains to bury. In the alternative, we could keep these guys in a real jail.
PPPS: A major complaint about Lance is his apparent inability to apprehend the inferences from what he himself writes. A classic example is the article about the wheelchair-bound sex offender allegedly beaten to death by other prisoners. I have read at least a dozen articles where Tapley bristles with anger at SOLITARY for the poor mentally ill inmates -- FOR THE PROTECTION OF OTHER INMATES.
PS: I just LOVE the statement as FACT that this guy was "disorderly" on the outside, but his nature changed in jail. With Mr. Tapley, it is always a conspiracy against the "mentally ill". I have a friend that was "interviewed" by him for an article. He had it already written. The only thing he did was cross out the facts that she would not confirm. The actual stuff she said, to the extent it differed from what he PREVIOUSLY decided was true, seemingly never made it into print.
PPS: It STILL needs to be investigated. The state has a decent track record of PROSECUTION of guards who misbehave. I have no reason to believe that they will "Tank" this investigation.
Jim, please explain. How did they conspire to violate his rights and what property did they "steal?"
The trumped up charges to get access to his home and they stole his guns without cause...
Actually, he needs a deep pocket civil rights organization to begin laying the groundwork for a Title 18 civil rights case directed at the officers involved by name for denying the fellow his rights under the color of their office...
The arrest was illegal, the search was illegal and the seizure was illegal...
When a deputy sheriff began questioning Melissa Greenfield's boyfriend, she began recording video with her cell phone.
Sgt. Burke wrote that he repeatedly ordered Greenfield to place the "unknown" object in her pocket and keep her hands free. When Greenfield refused, she was arrested and charged with obstructing official business and resisting arrest.
Burke wrote in his report that he feared that Greenfield could have been holding a dangerous object such as a "cell-phone gun."

How about those instances where Swat teams either bust into the wrong house or greatly over-respond to a routine incident? People have even had their dogs shot. How about the following: a Missouri Swat team storms a home shoots the pet dogs, terrifies the children all over what? A small bag of pot.

1) did the team have a warrant, issued by a judge? Did it actually and accurately describe the place to be searched?
2) Is this a case where the home occupants might have been "tipped off"? If I was a drug dealer suspectng I might be busted I'd be disiclined to keep merchandise onsite.
As for the dogs - heck, I can't get the video to open. Shooting dogs as an opening move didn't work out so well in Randy Weaver v. Horiuchi, et al. However, if the doggies are attack - trained pits, the team pobably has the right house.
Let the second guessing begin. Harmless indoor sport.
I was able to watch all three videos. What I find interesting is the times on the video from the cruiser dash cams. If you really want to convince me that this was an illegal search then run it from beginning to end in consecutive order...not going forward then backward then jump forward 15 minutes to come back 6 minutes to go forward 8 minutes to come back 2 minutes to go forward 4 minutes then go forward 40 minutes and come back 15 minutes...this is ridiculous.
How do you expect anybody with a reasonable sense of good judgement to understand this. Sure, the way it is put together...it looks illegal, but show it to me consectively run non-stop and we will see.
The problem with that view is that the unedited bits where the police are discussing how to make their already done search legal and deciding amongst themselves how to charge the fellow to support their decision to search. They coluded amongst themselves to cover up what they knew darned well to be an illegal search...listen to the charges the DA filed...ALL 100% absolutely bogus as refuted with unedited bits of the videos.
Just because they wear a badge does not mean they get to manufacture crimes to charge the guy with after the police themselves break the law and violate the fellows basic rights...yet they did it...
Oh, there was no warrant...the discussion after the search was about the 'exigent circumstances' loophole in the 4th amendment warrant requirement. The question to be asked has to be, what possible exigent circumstance could apply when the home owner was already cuffed and the gun safe secured by lock? The answer is none at all...
I do know that one of the dogs shot was a Corgi - hardly known as a big threat to man, especially heavily armed Swat guys.
