Anti-Constitutionalism Exposed

This piece pretends that leftist judges haven't been re-interpreting the Constitution to suit their own views all along... but claims that "originalism" is conservative re-interpretation.

https://www.theguardian.com/commentisfree/2018/nov/22/us-constitution-pr...

The constitution was intentionally written in broad, open-ended language that rarely provides guidance for issues that must be resolved by the supreme court. What is “cruel and unusual punishment” or “due process” or “equal protection” cannot be determined by the words of the text or the intent of its drafters, who wrote long ago for a vastly different world. What’s more, no constitutional right is absolute: constitutional cases constantly involve weighing the government’s interest against the claim of a right by some other member of society.

"Thing of Wax" indeed...

We don;t need to read further

We don't need to read further than this:
1."The constitution was intentionally written in broad, open-ended language that rarely provides guidance for issues that must be resolved by the supreme court."
2."...who wrote long ago for a vastly different world."
3. "What’s more, no constitutional right is absolute: constitutional cases constantly involve weighing the government’s interest against the claim of a right by some other member of society."

1. Words mean things and language is precise. Intentional obfuscation is a familiar tool used by relativists
2. The world is not different at all. Humans have not changed in any way, at all, absolutely. When you hear this, it is a lie fomented by pride.
3. Constitutional rights are absolute, and all power not enumerated in the Constitutional are reserved to individuals and the states, i.e., the ninth and tenth amendments. Precedent, obliquely referenced in the above quote and in other "opinions" which disparage the ninth and tenth as imprecise and hard to defend legally (they are not and that is a straw argument made by relativists), is an improper way to adjudicate, and is based on the disproved theory of evolution, the religion of the aforementioned relativists.

This is simply the same shallow thinking regurgitated by those of us who must depend on relativism to explain the inconsistency, prejudice, and immorality in our own personal lives.

"Added to these goals should

"Added to these goals should be achieving equality, something omitted from the original constitution, which protected slavery and envisioned no civil rights for women or racial minorities." .
That is more important than anything as it is wrong.
This assumes the writers failed to do this for a purpose which is not true. The decision to not deal with the slavery issue was done to facilitate adoption of the document for ratification by the states. The need to create a foundation for a workable government outweighed the issue.
